Statement on reparations

“You and the other companies are cited because you aided and abetted the Apartheid regime in its orgy of murder, torture, rape and kidnapping during the period indicated in our complaint, that is from the time of the Sharpeville shooting until the end of Apartheid rule. You are well aware that at that time you, jointly and severally with the others cited above, offered the Apartheid regime financial support, supplies of strategic goods, such as armaments, energy resources and motorised transport vehicles, and computer support.”

Memorandum presented by the November 6 Action Committee to Barclays Bank

Jubilee South Africa, the Khulumani Support Group and the other people's organisations listed
below and working collectively in the November 6 Action Committee, are handing over this
memorandum to you in support of the Apartheid reparations claim.

The claim we are referring to is the Khulumani Support Group and Jubilee South Africa lawsuit
for claimants who suffered at the hands of the Apartheid regime and against foreign banks and
companies that supported the regime.

Today, we have heard testimonies from those who have suffered, seen people performing
cultural activities on reparations and collectively marched through the streets of Johannesburg
with our placards, Reparations Yes! There have been similar activities in Rustenburg, Cape
Town and East London. In addition, our partners in Switzerland and Germany have held events
to inform the media about our actions and the Apartheid reparations claim.

These activities are taking place in support of our lawyers, Michael Hausfeld and Charles
Abrahams, who are today arguing the merits of proceeding with the case before Judge Sprizzo
in the Southern District Court of New York.

We are delivering this memorandum to you, Barclays Bank, as you are one of the companies
cited as defendants in the lawsuit. You will no doubt be aware of the other companies,
including:

Ford,
Fluor,
Fujitsu,

Royal Dutch Shell,
Total Fina-Elf, and
UBS.

You and the other companies are cited because you aided and abetted the Apartheid regime in
its orgy of murder, torture, rape and kidnapping during the period indicated in our complaint,
that is from the time of the Sharpeville shooting until the end of Apartheid rule.

You are well aware that at that time you, jointly and severally with the others cited above,
offered the Apartheid regime financial support, supplies of strategic goods, such as
armaments, energy resources and motorised transport vehicles, and computer support. The
Apartheid regime was increasingly reliant on this support to wage its terrible actions on the
people of South Africa as well as to continue the existence of that inhuman system well into
the 1990s.

Since the end of Apartheid, you and the other defendants have been silent on your complicity
with the Apartheid regime, whilst continuing to profit from the servicing of the Apartheid debt
and other business arrangements, in a country still defined by the gross inequality created by
the Apartheid system.

As long ago as 1999, we made our first approach to initiate discussions on these serious
matters with the Swiss Banks cited in the case. This and all subsequent approaches to those
cited has been met with your collective obstinate refusal to acknowledge the role you have
played in supporting the Apartheid regime and your embargo on any form of engagement with
our organisations and the affected individuals.

This has left us with no alternative but to go the legal route. You have, together with all those
cited, continued to maintain a hostile position in the form of your efforts to dismiss the case.

This memorandum thus serves to reflect the growing mobilisation of South Africans and
international allies in support of our claim. We offer you the promise that we shall continue to
mobilise and organise support for the claim and for reparations. We will not rest until the just
demands of the people have been met.
